3. Account Registration

4. Property Listings

  • Listing Content: If you are a property owner or agent, you may post property listings on the Site. You are solely responsible for the accuracy, completeness, and legality of your property listings. You represent and warrant that you have all necessary rights to list the properties and that your listings comply with all applicable laws and regulations, including fair housing laws and advertising standards.
  • No Verification: South Property Find acts as a classifieds platform and does not verify or guarantee the accuracy, legality, or safety of any property listing. We are not responsible for the content of property listings, and users should conduct their own due diligence and verification.
  • Prohibited Listings: You agree not to post listings that are fraudulent, misleading, inaccurate, illegal, discriminatory, or that infringe upon the rights of others. We reserve the right to remove any listing that violates these Terms or that we deem inappropriate for any reason, without notice.
  • Fair Housing: You agree to comply with all applicable fair housing laws and regulations and not to discriminate based on race, color, national origin, religion, sex, familial status, disability, or any other protected characteristic.
  • Transactions at Your Own Risk: Any transactions or agreements you enter into with buyers or renters who find your property listing on our Site are solely between you and those parties. South Property Find is not a party to any such transactions and is not responsible for any aspect of these transactions.

5. User Conduct

You agree to use the Site in a responsible and lawful manner. You agree not to:

  • Violate any laws or regulations: Use the Site in any way that violates any applicable national, regional, local, and international laws, regulations, or ordinances.
  • Infringe on Intellectual Property Rights: Infringe, violate, or misappropriate any third-party rights, including any copyright, trademark, patent, trade secret, moral right, privacy right, right of publicity, or any other intellectual property or proprietary right.
  • Post Inappropriate Content: Post, upload, transmit, or otherwise distribute any content that is unlawful, defamatory, libelous, harassing, abusive, fraudulent, obscene, threatening, or otherwise objectionable.
  • Interfere with the Site: Interfere with or disrupt the operation of the Site or the servers or networks used to make the Site available, or violate any requirements, procedures, policies, or regulations of such networks.
  • Attempt Unauthorized Access: Attempt to gain unauthorized access to the Site, accounts, computer systems, or networks connected to the Site, through hacking, password mining, or any other means.
  • Collect User Information: Collect or harvest any personally identifiable information, including account names, from the Site, nor to use the communication systems provided by the Site for any commercial solicitation or spam purposes.
  • Impersonate Others: Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity.
  • Promote Illegal Activities: Promote or encourage illegal activity.
  • Misuse the Site: Use the Site for any purpose other than its intended purpose as a real estate classifieds platform.

6. Intellectual Property

  • Site Content: The Site and its original content (excluding property listings posted by users), features, and functionality are and will remain the exclusive property of South Property Find and its licensors. The Site is protected by copyright, trademark, and other laws of various jurisdictions. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of South Property Find.
  • Limited License: Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for your personal, non-commercial use to search for properties or list properties for sale or rent, in accordance with these Terms.

7. Disclaimer of Warranties

THE SITE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE MAKE NO WARRANTY THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. WE DO NOT WARRANT THE ACCURACY, COMPLETENESS, OR USEFULNESS OF ANY INFORMATION ON THE SITE, INCLUDING PROPERTY LISTINGS. ANY RELIANCE YOU PLACE ON SUCH INFORMATION IS STRICTLY AT YOUR OWN RISK.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SOUTH PROPERTY FIND, NOR ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SITE; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SITE; (III) ANY CONTENT OBTAINED FROM THE SITE; AND (IV) UNAUTHORIZED ACCESS, USE OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE) OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE, AND EVEN IF A REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.

SPECIFICALLY REGARDING PROPERTY TRANSACTIONS: SOUTH PROPERTY FIND IS A CLASSIFIEDS PLATFORM ONLY AND IS NOT INVOLVED IN TRANSACTIONS BETWEEN USERS. WE ARE NOT RESPONSIBLE FOR, AND EXPRESSLY DISCLAIM ANY LIABILITY FOR, ANY LOSS, DAMAGE, OR HARM ARISING FROM OR RELATED TO PROPERTY LISTINGS, PROPERTY TRANSACTIONS, OR INTERACTIONS BETWEEN USERS, INCLUDING BUT NOT LIMITED TO: INACCURATE LISTINGS, FRAUD, PROPERTY DEFECTS, BREACH OF CONTRACT, OR ANY OTHER DISPUTES. USERS ARE SOLELY RESPONSIBLE FOR CONDUCTING THEIR OWN DUE DILIGENCE AND SEEKING PROFESSIONAL ADVICE BEFORE ENTERING INTO ANY PROPERTY TRANSACTION.

9. Indemnification

You agree to defend, indemnify and hold harmless South Property Find and its affiliates, officers, directors, employees, and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney’s fees), arising from: (i) your use of and access to the Site; (ii) your violation of any term of these Terms; (iii) your violation of any third party right, including without limitation any copyright, property, or privacy right; or (iv) any claim that your User Content caused damage to a third party. 

10. Termination

We may terminate or suspend your account and access to the Site immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the Site will cease immediately.

11. Governing Law

12. Changes to Terms of Use We reserve the right, at our sole discretion, to modify or replace these Terms at any time. By continuing to access or use our Site after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Site.
